  The Tenant shall have the right to use the common areas shared by all tenants.

  The Tenant shall use the leased property only for residential purpose.

  2.5 本合同附件一為房產(chǎn)證明或購(gòu)房合同及業(yè)主身份證復(fù)印件(營(yíng)業(yè)執(zhí)照復(fù)印件)。

  本合同附件二為家具、附屬裝置和電器的清單。

  Copy of ownership Certificate of Leased Property or purchased contract of leased Property and copy of the landlord’s identity certificates (business license) is attached as Appendix I to this Contract.

  The list of the furniture, fixtures and appliances in the leased property is attached as Appendix II to this Contract.)

  第三條、租期

  Article3. Lease Term 3.1 租期為1年,自x xxx 起,至xxxxx日止。

  3.2 合同期滿后本合同終止,承租人若想延長(zhǎng)租期,應(yīng)在租期屆滿前的至少1個(gè)月書(shū)面通知出租人。

  第四條、租金與支付條款

  Article4. Rent and Terms of Payment

The extra utility fee over the above mentioned limitation should be paid by the tenant.

  第五條、管理服務(wù)與管理費(fèi)

  Article5. Management Services and Management Fee

  出租人應(yīng)對(duì)該租賃房產(chǎn)進(jìn)行維護(hù)。管理費(fèi)用包括,但不限于,建筑物內(nèi)外的公共用地的清掃、對(duì)指定的垃圾箱內(nèi)垃圾的清除,該地區(qū)電線和管道設(shè)施維護(hù)的費(fèi)用。

  The Landlord shall conduct maintenance on the leased property. The management fee includes, but is not restricted to, the cleaning of common areas, garbage removal from designated dustbins, maintenance of electric wiring and plumbing facilities on the area.

  第六條、稅費(fèi)

  Article6. Taxes and Fees

  出租人應(yīng)支付政府部門(mén)向其征收的除租房稅金外的所有稅費(fèi)。

  The Landlord shall pay all taxes and fees levied on him by the authorities except the rent tax.

  第七條、租賃房產(chǎn)的狀況

  Article7. Status of Leased Property 7.1 出租人應(yīng)不遲于租期的第1(大寫(xiě):壹 )天將該租賃房產(chǎn)以清潔、良好的狀態(tài)移交給承租人,并在移交的同時(shí)交

  出該租賃房產(chǎn)的鑰匙。

  The Landlord shall deliver the leased property to the Tenant in a clean and good condition no later than on the 1st (in words: first) day of the lease term. The Landlord shall hand over keys of the leased property at the time of delivery.

  7.2 出租人在任何時(shí)間都應(yīng)使該租賃房產(chǎn)保持良好的狀態(tài)。出租人應(yīng)對(duì)房產(chǎn)的結(jié)構(gòu)及各項(xiàng)設(shè)施和設(shè)備 進(jìn)行維護(hù),

  并在出現(xiàn)問(wèn)題的情況下及時(shí)糾正或維護(hù);如果出租人沒(méi)有在合理時(shí)間內(nèi)但不遲于接到通知后的一個(gè)星期內(nèi)糾正該問(wèn)題,則承租人有權(quán)請(qǐng)求賠償和/或糾正該瑕疵,費(fèi)用由出租人承擔(dān),承租人應(yīng)向出租人提供所付費(fèi)用的資料和收據(jù)。30天內(nèi)未能解決,承租人有權(quán)立即搬出此房,并不承擔(dān)任何賠償。

  The Landlord shall at all times keep the leased property in good condition. The Landlord shall provide maintenance to the property and repair defects such as: cracks on the wall in a structure; electric appliance works unproperly; construction against the local or compound regulation. If the Landlord fails to correct defects within due time but not later than 1 week after being notified, the Tenant shall have the right to claim damages and or correct the defects at the expense of the Landlord. The Tenant shall provide the Landlord with documentation and receipts of costs incurred. There shall be no penalty provided it cannot be solved in 30 days, and The Tenant has the right to check out.

  7.3 在非因承租人過(guò)錯(cuò)租賃房產(chǎn)出現(xiàn)問(wèn)題的情況下,比如,但不限于空調(diào)故障,出租人應(yīng)在收到承租人的通知后毫

  不遲延地進(jìn)行維修或糾正。 如果出租人未能及時(shí)解決問(wèn)題,則承租人有權(quán)自行或聘請(qǐng)第三方進(jìn)行維修,維修產(chǎn)生的費(fèi)用由出租人承擔(dān),承租人應(yīng)向出租人提供所付費(fèi)用的資料和收據(jù)。同時(shí),出租人應(yīng)向承租人賠償維修費(fèi)用以外的其他損失(若有)。

  In case of any problem of the Premises not arising from the Tenant’s fault, including but not limited to a

  defective air conditioner, the Landlord shall carry out remedy or repair without delay upon receiving a notice from the Tenant. If the Landlord fails to resolve such problems within due time (not later than 1 week after being notified), the Tenant shall have the right to have it repair by itself or any third party at the expense of the Landlord. The Tenant shall provide the Landlord with documentation and receipts of costs incurred.

  Meanwhile, the Landlord shall indemnify from the Tenant any other loss in addition to the repair fees, if any.

  第八條、使用規(guī)則

  Article8. Rules of Occupancy

  承租人應(yīng)遵守下列使用規(guī)則:

  The Tenant shall follow the rules of occupancy as follows: 8.1 承租人只應(yīng)將該租賃房產(chǎn)作為其住處。

  The Tenant shall use the leased property only for residential purpose.

  8.2 承租人有義務(wù)杜絕在租賃房產(chǎn)內(nèi)從事任何會(huì)對(duì)其他承租人或出租人造成不合理干擾的活動(dòng)。

  The Tenant shall not allow anything to be done on the leased property that would unreasonably disturb other tenants or the Landlord.

  8.3在租賃期間,承租人應(yīng)有義務(wù)使該租賃房產(chǎn)保持干凈和良好的條件。正常的損耗應(yīng)指在承租人及其家人的正常和合理使用期間產(chǎn)生的損耗。

  The Tenant shall have the duty to keep the leased property clean and in a good condition for the duration of the lease term. Fair wear and tear shall mean such wear in the house is exposed to during the normal and reasonable use by a Tenant and Tenant’s family.

  8.4 承租人如果發(fā)現(xiàn)租賃房產(chǎn)中的供電、煤氣或供水設(shè)施、電線或管道已證明有危險(xiǎn)或可能證明有危險(xiǎn),應(yīng)毫不遲

  延地書(shū)面通知出租人。

  The Tenant shall give written notice to the Landlord without delay when the Tenant becomes aware of any electrical, gas or water installation, wiring or piping on the leased property that proves to be, or may prove to be, a danger.

  8.5 承租人應(yīng)當(dāng)補(bǔ)償出租人因更換或修理被承租人或承租人負(fù)責(zé)的人損壞或破壞的租賃房產(chǎn)中的任何用物而導(dǎo)致

  出租人的所有直接費(fèi)用。出租人必須能夠提供有關(guān)文件和正式發(fā)票以要求付款。正常的損耗不應(yīng)構(gòu)成任何該損壞或破壞。

  The Tenant shall compensate the Landlord for all direct costs incurred by the Landlord in replacement or repair of any item on the leased property damaged or destroyed by the Tenant or a person for which the Tenant is responsible. The Landlord must be able to provide documentation and official invoice to claim payment. Fair wear and tear shall not constitute any such damage or destruction.

  8.6 承租人應(yīng)采取一切合理的預(yù)防措施使租賃房產(chǎn)內(nèi)部免受暴風(fēng)雨和其他不利的天氣的影響,并應(yīng)在 遇有該類天

  氣條件的危險(xiǎn)時(shí)采取適當(dāng)措施,比如確保所有的外部門(mén)窗都已安全鎖住或關(guān)閉。

  The Tenant shall take all reasonable precautions to protect the interior of the leased property against

  damages from storms and other adverse weather conditions and shall, upon threat of such weather condition, take appropriate action, such as, but not restricted to, to ensure that all exterior doors and windows are securely locked or closed.

  8.7 承租人應(yīng)遵守已公布的中國(guó)法律和法規(guī),并且不得允許在租賃房產(chǎn)上從事任何非法活動(dòng)。

  The Tenant shall comply with the published Chinese laws and regulations and not permit any unlawful activities on the leased property.

  第九條、進(jìn)入租賃房產(chǎn)的權(quán)利

  Article9. Right to Enter the Leased Property 9.1 出租人進(jìn)入租賃房屋內(nèi)進(jìn)行正常必要的維修保養(yǎng)工作,應(yīng)當(dāng)提前7天書(shū)面通知承租人,經(jīng)承租人同意后方可進(jìn)

  入維修場(chǎng)所;若在緊急情況下無(wú)法提前通知承租人,且不緊急進(jìn)入租賃房?jī)?nèi)進(jìn)行搶修或搶救將會(huì)產(chǎn)生嚴(yán)重后果的,出租人有權(quán)在物業(yè)管理人員陪同下,立即進(jìn)入租賃房屋內(nèi)從事緊急維修、搶救工作。

  Upon written notice the Landlord shall have the right to enter the leased property to perform necessary

  maintenance work. In an event of emergency, the Landlord shall have the immediate right to enter the leased property without any prior notice.

  9.2 租期屆滿前一(大寫(xiě):壹)個(gè)月之內(nèi),在發(fā)出通知后,出租人有權(quán)讓將來(lái)可能的新租戶參觀該租 賃房產(chǎn), 但需要

  提前通知承租方的居住人。

  Within 1 (in words: one) months of the end of the lease term the Landlord shall have the right upon written notice to show the leased property to prospective new tenants.

  第十條、轉(zhuǎn)租權(quán)

  Article10. Subletting Rights

  經(jīng)出租人同意,承租人有權(quán)以合理事先書(shū)面通知出租人全部或部分將租賃房產(chǎn)轉(zhuǎn)租給其關(guān)聯(lián)企業(yè)或?qū)⒈竞贤爬ㄞD(zhuǎn)讓給其關(guān)聯(lián)企業(yè)。

  The Landlord agrees that the Tenant is entitled to entirely or partially sublease the Premises or assign this Contract to any of its Affiliate subject to a reasonably advance notice to the Landlord.

  第十一條、終止

  Article11. Terminate

  11.1 租期滿11個(gè)月之后, 承租人在任何時(shí)候都可通過(guò)提前 1 (大寫(xiě):壹)個(gè)月書(shū)面通知終止本合同。

  After 11 months of this leasing term, the Tenant may at any time terminate this Contract under condition of providing one month prior written notice to the Landlord.

  11.2 如果租金的支付自到期之日起遲延30(大寫(xiě):叁拾)天以上并至少超過(guò)出租人發(fā)出書(shū)面通知后的30 (大寫(xiě):叁拾)

  天,出租人應(yīng)有權(quán)終止本合同。

  In the event that payment of rent is delayed for more than 30 (in words: thirty) days from the date due and at least 30 (in words: thirty) days after written notice from the Landlord to the Tenant stating the delay is issued the Landlord shall have the right to terminate this Contract.

  11.3 如果任何一方資不抵債,或者公司進(jìn)入清算階段,另一方應(yīng)有權(quán)終止本合同。

  In the event that any of the parties becomes bankrupt or in case a company goes into liquidation the other party shall have the right to terminate this Contract.

  第十二條、違約

  Article13. Breach of Contract

  12.1 由于出租人違約,承租人有權(quán)不支付租金,且已支付的當(dāng)期租金需全額歸還。

  The Tenant shall have the right to withhold rent payments for Landlord’s breach of contract

  12.2 由于承租人違約,出租人有權(quán)不退還承租方已支付的租金。

  The landlord shall have the right not to hand back rent payments for tenant’s breach of contract.

  12.3 如果出租人拖延糾正租賃房產(chǎn)上的瑕疵,則承租人有權(quán)自行糾正瑕疵并從租金中扣除所支出的費(fèi)用,條件是承

  租人有詳細(xì)的資料和收據(jù)證明其扣除額。

  In the event that the Landlord is in delay with correcting defects on the leased property the Tenant shall have the right to correct defects himself and deduct the costs from the rent provided the Tenant supports the deduction with detailed documentation and receipts.

  12.4 除了本合同所提到的其他違約,如果本合同的任何一方違反了本合同,受損方應(yīng)有權(quán)就其所受的損失請(qǐng)求賠償。

  Apart from other breaches of contract mentioned in this Contract, if either party to this Contract breaches the contract, the injured party shall have the right to be compensated for direct damages suffered. 12.5 在租賃期內(nèi),出租人或承租人中的任何一方均有權(quán)以提前一個(gè)月通知并支付相當(dāng)于一個(gè)月租金

  額的補(bǔ)償金給對(duì)方為條件提前解除本租賃合同。承租人在收到正式發(fā)票后30天內(nèi)支付補(bǔ)償金給出租人。

  During the leasing term, any Party has the right to terminate the contract with one month prior writen notice under condition of paying equal one month rental as compensation to the other side. The tenant will only pay the compensation to the landlord within 30 days after received tax invoice from the landlord.

  第十三條、規(guī)章制度

  Article13. Rules and Regulations

  承租人應(yīng)遵守出租人為管理租賃房產(chǎn)和公共場(chǎng)地而制定的規(guī)章制度。出租人必須在該規(guī)章生效前 3 (大寫(xiě):叁)天書(shū)面通知承租人。如果該規(guī)章制度與本合同有沖突,則以本合同為準(zhǔn)。

  The Tenant shall follow such reasonable rules and regulations issued by the Landlord for the management of the leased property and common areas. The Landlord must inform the Tenant in writing of such regulations at least 3 (in words: three) days before the effectiveness of the regulations. In the event such rules and regulations are in contradiction to this Contract, the terms of this Contract shall prevail.

  第十四條、爭(zhēng)議解決

  Article14. Dispute Resolution 由本合同引起的.、或由關(guān)于本合同的履行引起的任何分歧和爭(zhēng)議應(yīng)由合同雙方友好協(xié)商解決。如協(xié)商不成,依

  據(jù)《中華人民共和國(guó)合同法》規(guī)定,雙方約定交由承租方所在地人民法院裁決。

  Any differences or disputes arising from this Contract or from agreements regarding its performance shall be settled by an amicable effort on the part of both parties to this Contract. If negotiation fails, Both parties agree the dispute shall be settled by application of Chinese law under the jurisdiction of the local court of the tenant.

  第十五條、不可抗力

  Article16. Force Majeure 15.1 如果因不可抗力而無(wú)法履行本合同項(xiàng)下的義務(wù),出租人和承租人都不應(yīng)承擔(dān)責(zé)任。不可抗力應(yīng)指不可預(yù)見(jiàn)、超

  Neither the Landlord nor the Tenant shall be liable for failure to meet contractual obligations under this Contract due to force majeure. Force majeure shall mean such unforeseeable occurrences beyond the reasonable control of a Party such as, but not restricted to: Acts of God, natural disasters, labor disputes, war or warlike conditions, riot, sabotage and serious fire.

  Article16. Miscellaneous Clauses 16.1 修訂 Amendments

  本合同所有的附件、修訂、補(bǔ)充和變更應(yīng)書(shū)面做成,并在雙方通過(guò)協(xié)商達(dá)成一致后由雙方合法授權(quán)的代表簽署。

  它們構(gòu)成本合同的組成部分,與本合同具有同等效力。

  All annexes, amendments, supplements and alterations to this Contract shall be made in writing and signed by the duly authorized representatives of both parties upon the agreement reached between both parties through consultations. They shall form integral parts of this Contract and have the same force as this Contract itself.

  16.2 通知 Notice

  出租人和承租人特此約定,所有關(guān)于對(duì)方的權(quán)利或義務(wù)的交給對(duì)方的通知應(yīng)書(shū)面作出。

  The Landlord and the Tenant agree hereby that all notices to be delivered to the other Party with regard to either Party’s rights or obligations shall be in writing and be sent by messenger, mail, facsimile or courier.

  16.3 語(yǔ)言 Language

  本合同以英文和中文做成。如有分歧,以中文為準(zhǔn)。

  This Contract is written in both English and Chinese. If there are any differences between the English version and Chinese version, the Chinese version shall prevail.

  16.4 可分割性 Severability 如果本合同的某一條或某一款被認(rèn)定無(wú)效,則本合同的其他條款繼續(xù)有效,各方應(yīng)盡最大努力達(dá)成一與本

  合同的總體意向和目的一致的、且其經(jīng)濟(jì)效果相當(dāng)于無(wú)效條款的新條款。

  Should an individual provision or clause in this Contract be held invalid or unenforceable, the remaining provisions of this Contract shall continue in force, and the parties shall use their best efforts to arrive at a new provision or clause consistent with the overall intent and objectives of this Contract and which in terms of its economic result corresponds to the invalid provision.

  16.5 生效日期 Effective Date

  雙方簽署本合同之日起即為本合同的生效日,本合同一式叁份,出租人執(zhí)一份,承租人執(zhí)貳份。

  The effective date of this Contract shall be when it has been signed by both parties and registered with the authority as required by law.

  第十七條、簽字

  Article17. Signatures

  本合同由各方合法授權(quán)的代表簽字蓋章。

  This Contract is signed and sealed by the authorized representatives of the parties hereto.

  【附】具有以下情況的房屋不能出租:

  (一)未依法取得房屋所有權(quán)證的;

  (二)司法機(jī)關(guān)和行政機(jī)關(guān)依法裁定、決定查封或者以其他形式限制房地產(chǎn)權(quán)利的;

  (三)共有房屋未取得共有人同意的;

  (四)權(quán)屬有爭(zhēng)議的;

  (五)屬于違法建筑的;

  (六)不符合安全標(biāo)準(zhǔn)的;

  (七)已抵押,未經(jīng)抵押權(quán)人同意的;

  (八)不符合公安、環(huán)保、衛(wèi)生等主管部門(mén)有關(guān)規(guī)定的;

  (九)有關(guān)法律、法規(guī)規(guī)定禁止出租的其他情形。
